Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Shop Vitals service at shopvitals.co (the “Service”), operated by Darren Squashic LLC DBA Traverse Design(“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Shop Vitals monitors the performance of websites you add by retrieving PageSpeed Insights and Core Web Vitals data on a schedule and presenting it to you. The performance scores and field data are produced by Google and other third parties; we surface that data but do not control it and do not guarantee its accuracy, completeness, or availability.

2. Beta service

The Service is currently offered free of charge during a beta period. Beta features may be incomplete, may change, and may be less reliable than a generally available product. We may modify, suspend, or discontinue all or part of the Service, and may begin charging for it in the future, at any time. If we introduce paid plans, we will give you notice and an opportunity to decline before charging you.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. During the beta, access is invite-only. You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity that occurs under your account. Notify us promptly at hello@shopvitals.co if you suspect unauthorized use.

4. Acceptable use

You agree not to:

  • Add or monitor websites you do not own or otherwise have permission to monitor;
  • Use the Service to violate any law or the rights of any third party;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Interfere with or disrupt the Service, including by overloading, scraping, or circumventing any rate limits or usage restrictions;
  • Reverse engineer, resell, or redistribute the Service except as permitted by law.

You are responsible for ensuring your use of the Service, including the sites you choose to test, complies with the terms of Google’s PageSpeed Insights and any other third-party services involved.

5. Your content

You retain ownership of the information you submit, such as the site URLs and labels you add. You grant us a limited license to use that information as needed to operate and provide the Service. You are responsible for the content you submit and for having the rights to submit it.

6. Intellectual property

The Service, including its software, design, and branding, is owned by us and our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or content except the limited right to use the Service as intended. Shop Vitals is an independent third-party service and is not affiliated with, endorsed by, or sponsored by Shopify Inc. or Google LLC. Shopify is a trademark of Shopify Inc.; PageSpeed Insights and Core Web Vitals are services of Google LLC.

7. Third-party services

The Service relies on third-party providers, including Google, Supabase, and Vercel. Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for the acts, omissions, or availability of third-party services.

8. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the performance data shown will be accurate or reliable. You should not rely on the Service as your sole source of performance monitoring.

9. Limitation of liability

To the maximum extent permitted by law, Darren Squashic LLC DBA Traverse Design and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim (which, during the free beta, is zero) or one hundred U.S. dollars (US$100).

10. Indemnification

You agree to indemnify and hold harmless Darren Squashic LLC DBA Traverse Design and its owners from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict of law rules. You agree that the state and federal courts located in that state will have exclusive jurisdiction over any dispute that is not subject to arbitration or small-claims resolution.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after a change takes effect means you accept the revised Terms.
